TERMS AND CONDITIONS:
General Terms and Conditions of OTC Medical BV located at Oosterhout, Linie 13, 6678PK, The Netherlands registered with the Chamber of Commerce and Industry region Central Gelderland under number 09169525.
Article 1. General
OTC Medical BV is engaged in, among other things, and accepts orders concerning the delivery of products. OTC Medical BV supplies the aforementioned goods to both companies and private individuals.
Article 2. Definitions
In these General Terms and Conditions (hereinafter referred to as: Terms and Conditions) the following definitions shall apply:
Customer: any natural person or legal entity who enters into contact with OTC Medical BV about the formation of an Agreement;
Agreement: any agreement concluded between OTC Medical BV and the Customer, any amendment or supplement thereto, as well as all (legal) acts in preparation for and in execution of such agreement;
Products: Products we sell in this webshop;
Documentation: the documentation and manuals for products made available by or on behalf of OTC Medical BV for use by the Customer
Order: any order from the Customer to OTC Medical BV;
Notice: any possible notification from OTC Medical BV to the Customer, including - but not limited to - brochures, advertisements, catalogs, quotations, order confirmations, price lists, invoices, E-mail, fax on request, facsimiles and letters.
Article 3. Applicability of these terms and conditions These General Terms and Conditions shall form part of all Agreements and shall apply to all related (legal) acts of OTC Medical BV and the Customer. The applicability of any general specific terms and conditions or stipulations of the Customer is expressly rejected by OTC Medical BV. These General Terms and Conditions apply to all agreements concluded by OTC Medical BV with a Customer.
Artikel 4. Acceptatie deze voorwaarden
Door het plaatsen van een bestelling accepteert Afnemer de toepasselijkheid van deze Algemene Voorwaarden met uitsluiting van de Algemene Voorwaarden van de Afnemer of derden.
Artikel 5. Wijziging van de voorwaarden
Bij wijziging van deze algemene voorwaarden zal OTC Medical BV haar Afnemers hiervan in kennis stellen door middel van vermelding van de wijzigingsdatum onderaan de voorwaarden. Gewijzigde voorwaarden zijn toepasselijk op overeenkomsten ondertekend na wijzigingsdatum.
Artikel 6. Tariefwijzigingen
Het staat OTC Medical BV te allen tijde vrij de door haar gehanteerde tarieven te wijzigen. Eerder gehanteerde tarieven bieden geen rechten voor toekomstige overeenkomsten of leveringen.
Artikel 7. Omzetbelasting
Alle tarieven zijn inclusief de omzetbelasting.
Artikel 8. Betalingstermijn
Geschied altijd vooraf via de verschillende mogelijkheden op de betaalpagina.
Artikel 9. Levering van goederen
The delivery of goods to the Customer will take place after the full amount owed including shipping costs has been credited to OTC Medical BV's bank account. OTC Medical BV determines the method of shipment of the goods.
Article 9a. Force majeure
If OTC Medical BV is unable to deliver the ordered products to the Customer for a period of at least 30 days due to force majeure (including strike, technical defects and/or government intervention) or otherwise, the Customer has the right to terminate the contract. Any money paid will then be refunded. For the rest, OTC Medical BV shall not be obliged to pay any form of compensation.
Article 10. Delivery terms
A delivery time stated by OTC Medical BV is based on the circumstances prevailing at the time of the offer and, to the extent that it depends on the performance of OTC Medical BV's suppliers, on the information supplied to OTC Medical BV by those suppliers. Stated delivery times shall never be regarded as deadlines, unless expressly agreed otherwise. In the event of late delivery, OTC Medical BV must therefore be declared in default by registered letter, whereby it is given a reasonable period in which to perform. If the purchaser refuses to accept the goods or if he indicates that he no longer appreciates the agreed delivery, he shall nevertheless remain obliged to pay the agreed price and to compensate OTC Medical BV for the resulting costs, damages and interest. If the delivery time is exceeded, the Customer is not entitled to any compensation in this respect.
Article 10a. Partial deliveries n
OTC Medical BV has the right to deliver in parts at all times.
Article 11. Return guarantee
The Buyer - exclusively in the capacity of consumer - has the right to return the delivered Products to OTC Medical BV without stating any reason within 7 days of receipt. OTC Medical BV will then refund to the Buyer the received purchase price minus the shipping costs, under the following conditions:
Products have not been purchased for professional/business use;
The products in question must be described in the Message in question as goods to which the return guarantee applies;
No changes whatsoever may have been made to the delivered product and the delivered product must be in undamaged condition; all Documentation and packaging materials included must be enclosed with the return shipment;
The product must be unused and in undamaged packaging;
The return shipment must be in the possession of OTC Medical BV no later than the 18th day after receipt of the goods by the Customer;
The costs of postage of the return shipment are for the Customer;
Article 12. Liability
OTC Medical BV shall never be liable for damage or consequential loss if the products supplied do not function, or do not function completely, or are of inadequate quality.
Article 13 Disputes
Disputes which arise directly or indirectly from agreements concluded between OTC Medical BV and the Customer shall fall under the exclusive jurisdiction of the competent court in Arnhem, The Netherlands.
Article 14. Latest amendment
These General Terms and Conditions were last amended on 7 January 2019.
